Brad Robertson works with clients facing government investigations and litigations, dealing with whistleblower allegations and qui tam actions, and planning compliance programs to prevent these occurrences in the first place. He helps his clients navigate compliance and potential liability under the False Claims Act and Anti-Kickback Statute, in addition to other areas of healthcare fraud and abuse, financial/mortgage fraud, and white collar criminal law.
Whether necessitated by an employee raising compliance concerns, a visit from a government agent, or the receipt of an investigatory subpoena, Brad conducts confidential internal investigations for his clients to determine whether and where liability exists. Meanwhile, he works with clients to efficiently and cost effectively assess their documentation in order to respond to government inquiries.
Brad represents clients ranging from individuals to Fortune 100 companies—including institutional healthcare providers, physician practices, financial institutions, pharmaceutical manufacturers, medical device manufacturers and government contractors. He has represented clients under investigation by the Department of Justice, the Office of Inspector General of the Department of Health and Human Services, the Department of Housing and Urban Development, the Internal Revenue Service, the Food and Drug Administration, and various state attorneys general. He has also conducted confidential internal investigations concerning, among other things, healthcare provider compliance with federal and state governmental program requirements, mortgage servicing compliance with FHA and GSE requirements, pharmaceutical and medical device promotional and manufacturing practices, off-label promotion, anti-kickback issues, and pricing/reimbursement issues.
Brad joined the firm after working as an associate from 2007 to 2013 at a large, international law firm based in Chicago, Illinois.
