Rival Hanford Tank Disposition Alliance LLC filed a renewed protest in March, arguing [that] the DOE [U.S. Department of Energy] used what is supposed to be a general policymaking process for the sole benefit of H2C, and the unusual class deviation will come in for close attention from the court, he said.
“If agencies issue broad class deviations before solicitations, and they’re not aimed at restoring the eligibility of specific preferred awardees, then those deviations might be lawful,” Beezley explained. “But post-award deviations that are aimed at restoring eligibility of specific companies in specific procurements, those are going to have a really tough time surviving scrutiny.”
