Rather than tackle the PLA rule head-on, MVL USA Inc. and other contractors have challenged the rule as applied, arguing PLA clauses included in contract solicitations are effectively an “unauthorized socioeconomic set-aside” for companies that have signed a PLA, violating the typical federal acquisition requirement of “full and open” competition.
Those arguments are “pretty simple, they're straightforward, and I think they're persuasive,” said Beezley.
“It’s basically that the Competition In Contracting Act, as a default, requires full and open competition unless there's a statutory exception,” Beezley explained. “And here, agencies are effectively applying an exception to CICA that is not a statutory-based exception.”
