Kim Martin focuses her practice on general litigation. She has extensive experience representing media clients on First Amendment issues and defamation claims. Most recently, Kim and the Bradley team won summary judgment on behalf of Discovery Communications in a defamation suit brought by Dr. Judson Lovingood over his portrayal in a docudrama relating to the space shuttle Challenger disaster. The Eleventh Circuit recently affirmed the district court’s summary judgment decision (Lovingood v. Discovery Communications, Inc. et al., 2020 WL 599836, No. 18-12999, (11th Cir. Feb. 7, 2020)). 

Kim also has an emphasis on medical device and pharmaceutical products liability litigation, as well as white collar matters and False Claims Act litigation. She has tried cases in state and federal court. Most recently, she served as trial counsel defending a nationwide hospice provider in a three-month False Claim Act trial brought by the Department of Justice. The trial team's efforts ultimately resulted in a dismissal of the case. Her trial experience includes defense of personal injury, products liability, commercial litigation, and labor and employment claims.

Kim has represented multi-national pharmaceutical and medical device manufacturers in litigation across the country. She has been a national team member for sales and marketing issues defending a pharmaceutical company in multidistrict litigation throughout the United States. In this role, she had responsibility for discovery related to sales representatives. Kim has also served as counsel for several jurisdictions in hormone replacement therapy litigation. She has a wide range of experience in representing clients in general commercial litigation and was recognized by The Best Lawyers in America® as the Commercial Litigation "Lawyer of the Year" in Huntsville for 2013.

Notable Matters
  • Represented Time, Inc. in the defamation lawsuit brought against it by former University of Alabama football coach Mike Price.
  • Obtained dismissal of defamation and false light invasion of privacy claim against Southern Poverty Law Center.
  • Trial counsel in S. v. AseraCare, a three-month FCA trial.
  • National team member for Bayer on Sales and Marketing in the Yaz/Yasmin multidistrict litigation. 
  • Obtained summary judgment for Pfizer in products liability suit relating to use of hormone therapy medication, which was filed in the U.S. District Court for the Middle District of Alabama.
