    • Won a defense jury verdict in Oklahoma state court in favor of an oilfield service client in a wrongful death action arising out of a double fatality that occurred during a partial rig erection. Verdict was affirmed by the Oklahoma Court of Appeals (Division IV).

      Won summary judgment for E&P company in a catastrophic personal injury case arising out of a workplace incident during the disassembly of a drilling rig.

      Won summary judgment for E&P Company in a catastrophic person injury case where rig floor fell and struck the plaintiff in the head. The outstanding demand at the time of the summary judgment was $15 million. Plaintiff’s firm was Arnold & Itkin in Houston.

      Won summary judgment for E&P company and consulting firm arising out of a workplace accident where contractor stepped into open grating on a tank.

      Won summary judgment for E&P company in a workplace accident that resulted in the amputation of a contractor’s lower leg during the lowering of a drilling rig mast.

      Won summary judgment for major E&P company in West Texas in a double fatality matter arising out of vehicle accident where contractor was alleged to have been employee/agent of client.

      Won summary judgment for major oilfield service company in catastrophic personal injury matter arising out of a flash fire that occurred on a well site in North Dakota.

      Won summary judgment in South Texas (Nueces County) for major E&P company in accident when a wireline tool fell from derrick and struck contractor employee.

      Won summary judgment in West Texas for drilling contractor arising out of a workplace accident that resulted in the death of the drilling contractor’s employee.

      Won summary judgment in Oklahoma state court in favor of drilling contractor in alleged wrongful death case arising out of operations on a drilling rig.

      Won summary judgment for drilling contractor in South Texas (Cameron County) in a personal injury action involving a plaintiff involved in a single car accident resulting in a double amputation at the knee. Plaintiff asserted that client was not immune under the Texas Workers' Compensation Act. The summary judgment was granted based upon the applicability of the "dual employer" doctrine.

      Won summary judgment in Oklahoma State Court in favor of drilling contractor in alleged wrongful death case arising out of a workplace incident.

      Won summary judgment for oil and gas operator in South Texas (McMullen County) in a personal injury action arising from a rig floor accident resulting in the amputation of the rig employee's lower leg.

      Won summary judgment in favor of drilling contractor and operator in personal injury action where third-party employee fell through grating on a mud tank (applying Chapter 95 of the Texas Civil Practice & Remedies Code). Fifth Circuit affirmed summary judgment.

      Won summary judgment for oil and gas operator in Harris County, Texas, arising from oil field accident where the drilling contractor employee fell from a mud tank (applying Chapter 95).

      Defended a rental tool company in a lawsuit arising out of a flash fire on a drilling rig that resulted in severe burns to a drilling rig employee. Plaintiff alleged product defect in the rental equipment. After one week of pre-trial hearings, including eight expert challenges and three days of trial, the case settled for a confidential amount.

      Defended E&P company sued by drilling contractor employee severely burned when hydrocarbons ignited after the failure of a flowline connection. The matter settled for a confidential amount at mediation.

      Defended drilling contractor client in personal injury lawsuit in federal court in Oklahoma arising from an accident where a steel bar fell from the derrick and struck casing employee. The client stipulated to liability and entered into a high/low agreement with plaintiff and tried the matter to a federal jury.

  • Oilfield-Related Surface and Downhole Matters
    • Defended a rental tool company in a lawsuit arising out of a blowout wherein the operator alleged a product defect in a rented blowout preventer seeking alleged damages in excess of $40 million. The case settled for a confidential amount after five days of trial, significantly lower than the “bottom line” demand issued by the operator prior to the start of trial.

      Defended casing company in claim by operator arising from parted casing resulting in damage to wellbore. Settled for a confidential amount significantly lower than alleged damage model.

  • Non-Oilfield Death, Personal Injury, Premises and Products Liability
    • Won a defense jury verdict in favor of a bicycle manufacturer in a products liability case tried in Houston federal court arising out of an accident where the plaintiff suffered a fractured hip and claimed damages of approximately $1 million.

      Won a defense jury verdict in Hidalgo County, Texas, in a workplace personal injury matter where the plaintiff underwent a two-level lumbar fusion and was seeking approximately $1 million in damages at trial.

      Won a defense jury verdict in a property damage case in Fort Worth, Texas, involving the explosion of a nitrogen holding tank where plaintiff was seeking over $3 million in damages.

      Won a defense jury verdict in favor of local outdoor amphitheater and concert promoter against allegations that venue security assaulted a patron at a concert.

      Won summary judgment in Brazoria County, Texas, in a products liability case arising from the explosion of an oxygen cylinder where the plaintiff suffered severe burns on his arms, legs and torso.

  • Oilfield-Related Commercial Disputes
    • Represented E&P in a dispute related to the development of an oil and gas prospect in Colorado County, Texas, where client presented prospect to another oil and gas company, which induced client into providing confidential information and conveying portions of the prospect based upon misrepresentations and promises that were breached. The matter was successfully settled.

      Represented a drilling contractor in a contract dispute arising from the termination of drilling contract after cross-motions for summary judgment were filed. The matter settled at mediation with the parties reaching a business solution.

      Represented a drilling contract in a contract dispute over the premature termination of a drilling contract by an operator. Settled at mediation shortly before trial for an amount that ultimately totaled the amount owed under the contract’s liquidated damages provision.

  • General Commercial and Construction Litigation Matters
    • Successfully prosecuted a “bet the company” breach of contract case for a small company against a large pharmaceutical supply company after the defendant prematurely terminated the parties’ agreement. The case was tried for five days in federal court in Houston with a damage model of over $100 million. The matter was settled for a confidential amount on the last day of trial.

      Represented a client in a multimillion-dollar dispute with a contractor for a hydrogen plant over delay claims and warranty issues.

      Successfully prosecuted a counterclaim in a contract dispute where the customer prematurely terminated supply contract of industrial gases and preemptively sued client. After three days of trial before a Harris County jury, the parties reached a business solution more favorable to the client than a best-case verdict.

      Defended an engineering and construction company in a dispute relating to a bridge construction project.

      Tried and won an arbitration award in New York for national entertainment client against Canadian media company for breach of contract.

      Defended a media research company against allegations that a partnership agreement existed between the client and a telemarketing company when the client chose to terminate its vendor-client relationship. The case settled on shortly before trial for a fraction of plaintiff’s alleged damage model.

      Represented national media company in contract dispute with Howard Stern.
