A panel of the Fourth Circuit remanded the case case to district court and held that strict scrutiny standard must apply to the state bans. Kolbe v. Hogan, 813 F.3rd 160 (4th Cir. 2016), pet. reh'g en banc granted, 636 F. App'x. 880 (4th Cir. Mar. 4, 2016). Amicus curiae brief to the United States Supreme Court in support of Tennessee citizen's petition for writ of certiorari urging the Supreme Court to find that the Second Amendment right is a "core civil right" for the purposes of restoring civil rights under law. Brief for Nat'l Rifle Ass'n as Amicus Curiae Supporting Petitioner, Walker v. United States (2016) (No. 14-5703). Amicus curiae brief to the United States Supreme Court in support of an Illinois citizen’s challenge to a local government’s ban on popular modern sporting rifles and standard magazines. Brief for Nat’l Shooting Sports Found. as Amicus Curiae Supporting Petitioners, Friedman v. City of Highland Park (No. 15-133). Represented clients as part of a national appellate and litigation coordination team in amicus curiae briefs on issues related to consumer preferences in choice of firearms, common uses of firearms, and standard of review in Second Amendment constitutional challenges. Briefs filed in U.S. Circuit Courts of Appeal and U. S. District Courts throughout the United States. Representing a citizen of Tennessee in state law preemption challenge to municipality’s prohibition on permitted carry of a firearm in a public park in violation of state law. Representing an international firearms manufacturer in, inter alia, breach of contract and trade secrets lawsuit, arising out of design and production of AR-style platform semi-automatic rifles and semi-automatic handguns, and the sale of machining equipment, in Baltimore County (Maryland) Circuit Court. Defending international firearms manufacturer in the U.S. District Court for the District of Columbia, the U.S. Court of Appeals for the District of Columbia Circuit, and the U.S. District Court of Maryland, for product liability action resulting from the criminal use of a firearm in the District of Columbia. Resulted in dismissal of case for lack of personal jurisdiction in the District of Columbia. Williams v. Romarm, SA, 756 F. 3d 777 (D.C. Cir. 2014). Representing a firearms parts retailer in a breach of contract and nondisclosure agreement action. Amicus curiae brief to the Alabama Supreme Court in support of criminal defendant’s appeal of a conviction for menacing for being armed on his own property during verbal confrontation with trespasser. Brief for Nat’l Rifle Ass’n Civil Rights Defense Fund as Amicus Curiae Supporting Petitioner, Pate v. City of Tuscaloosa, 145 So. 3d 733 (Ala. 2013).
