      • Represented HVAC manufacturer in California state court against product defect claims relating to natural-to-propane gas conversion kit.
      • Defended boat motor manufacturer in South Carolina state court related to claims of product defect; obtained dismissal.
      • Obtained dismissal of claims in North Carolina federal court alleging exposure to talc caused injuries.
  • Commercial Litigation
      • Represented owner and seller of apartment community in AAA arbitration seeking recovery of escrowed funds when prospective buyer failed to close on a multimillion-dollar transaction during COVID-19 pandemic.
      • Represented part owner of multiple restaurants in North Carolina federal court in dispute with co-owners relating to financial operation of businesses. Obtained summary judgment on claims alleging fraud, unfair and deceptive business practices, violation of the North Carolina Securities Act and the Computer Fraud and Abuse Act, conversion, and breach of fiduciary duty, and subsequently obtained favorable verdict following jury trial.
      • Represented part owner of multiple restaurants in North Carolina business court in claims of constructive fraud and breach of fiduciary duty.
      • Defended public bottled water company in AAA arbitration against claims for breach of contract, fraud, and unfair and deceptive trade practices brought by former distributor.
      • Represented national mobility and accessibility equipment franchisor in North Carolina federal court seeking to enforce post-termination covenants following termination of franchisee.
      • Represented automotive service franchisor in North Carolina federal court alleging franchisees violated franchise agreements, including post-termination covenants not to compete, infringed trademarks, and misappropriated trade secrets.
      • Represented HVAC manufacturer in North and South Carolina courts in business disputes with contractors, subcontractors, and distributors related to monies owed.
      • Obtained full multimillion-dollar claim in AAA arbitration for regional accounting firm in government contract dispute with prime contractor relating to disaster recovery.
      • Represented aluminum wire manufacturer in North Carolina federal court related to allegations that drawn wire was non-confirming, defective good resulting in lost profits.
      • Obtained partial summary judgment in favor of publicly traded technology company’s CEO and CFO, resulting in dismissal of all business tort claims against executives. Subsequently obtained defense verdict in federal jury trial on behalf of company sued for breach of contract alleging damages of almost $10 million arising out of acquisition of web domains.
      • Represented regional food distributor in AAA arbitration relating to claims of breach of non-competition covenant following sale of business.
      • Represented estate of woman in North Carolina state court whose attorney misappropriated funds from her investment accounts and breached fiduciary duty in connection with sale of real property.
  • Appeals
      • Defeated motion to stay injunction in the Fourth Circuit against the world’s largest athletic retailer to halt an ad campaign that infringed the trademarks of a franchisor of athletic goods and services; and won dismissal of the retailer's appeal in the Fourth Circuit.
      • Represented the International Franchise Association as amicus curiae in a franchise case before the North Carolina Supreme Court challenging the North Carolina Business Court’s interpretation of an exemption from disclosure under the Federal Trade Commission's Franchise Rule.
      • Obtained reversal of trial court judgement in South Carolina Court of Appeals on behalf of mortgage servicer involving dismissal of foreclosure action on res judicata grounds and monetary damage claim based on failure to file a mortgage satisfaction.
      • Represented multiple mortgage servicing companies in the North and South Carolina Courts of Appeals in appeals involving foreclosures.
      • Obtained affirmance of jury verdict in the Fourth Circuit on behalf of commercial property owner related to claims that commercial tenant breached guaranty agreement.
      • Obtained affirmance of an attorney fee award in the Fourth Circuit against the Equal Employment Opportunity Commission.
      • Obtained affirmance of summary judgment in the Fourth Circuit on behalf of non-profit residential home for adults with disabilities related to employment claims under Title VII and the ADEA.
      • Represented large regional hospital in appeal of multimillion-dollar jury verdict before the North Carolina Supreme Court related to medical malpractice claim.
