Since beginning her legal career at Bradley, Avery Simmons has developed a diverse practice spanning multiple industries and jurisdictions. Avery practices in the Litigation Practice Group in the firm’s Charlotte office, and one of the primary focuses of her practice is the litigation of large commercial construction disputes. Avery has extensive experience representing owners, developers, engineers, and general contractors in state and federal courts and in private arbitrations. Her experience encompasses the construction of multifamily housing, campus housing, alternative energy projects, schools, highways, and major infrastructure projects. She has litigated or arbitrated cases involving non-payment, delay and acceleration claims, differing site conditions, changes, extra work, defective work, and consequential damages. As a native of Louisiana, Avery has also litigated several matters involving FEMA grant funds and disaster relief remediation efforts.
In addition to the practice of law, Avery previously served on the board of directors of her family company, giving her a unique perspective and understanding of the legal and business challenges faced by the management of privately held companies. This perspective allows Avery, in addition to her litigation practice, to assist her clients with contract negotiation and risk management of the front end of a project to help avoid claims and ensure a cost- efficient project delivery.
