  • Commercial Construction
    • Represented contractor joint venture in the negotiation of contract to construct Apple’s world headquarters building, known as Apple 2, located in Cupertino, California. Norman Foster designed the ring-shaped, 2.8 million-square-foot building costing $3 billion to construct. The structure is situated on 175 acres of land and has four stories above ground and three stories underground.

      Represented San Francisco-based developer in multimillion-dollar water intrusion and defective construction arbitration against its general contractor on multi-use project located in Conte Madera, California. Project suffered from widespread water intrusion and constriction deficiencies requiring extensive remediation. Case settled after 24 months of discovery for $48 million. Also represented the owner in multiple subcontractor suits filed in Marin County, California Superior Court.

      Represented New York-based developer in multimillion-dollar water intrusion and defective construction arbitration against its general contractor arising out of mixed-use development in Atlanta containing 10 retail and residential buildings. Remediation costs exceeded $16 million and more than $12 million was recovered in settlement.

      Represented contractor in month-long arbitration in Atlanta against student-housing developer involving client-asserted claims for delay, acceleration, unpaid change orders, and contract balance, and defended against the developer’s claims for defective work. The arbitration panel awarded the client $8 million, and the developer received nothing on its claims.

      Represented contractor in negotiation of contract for the construction of the U.S. Army Criminal Investigation Laboratory at Fort Gillem, Georgia. The laboratory performs forensic testing of evidence for criminal cases involving all Department of Defense Military personnel worldwide and contains an indoor firing range for forensic evaluation of firearms.

      Represented construction manager in civil action against the City of Charleston, South Carolina, and its designers for defects with the design documents and resulting schedule delays on the Gaillard Performing Arts Center project, a world-class performing arts center. Project transformed a 2,700-seat, general purpose civic hall to an 1,800-seat opera house with three tiers of horseshoe shaped balcony seating above the orchestra level.

      Represented big four accounting firm in civil action against its designer alleging design errors and added costs incurred in constructing the client’s national training center in central Florida.

  • Industrial/EPC
    • Represented independent power producer in Federal District Court for the Southern District of New York in suit against its engineering, procurement, and construction (EPC) contractor over disputed costs under $1 billion reimbursable cost contract to install wet scrubbers in three coal-fired power plants in Maryland. After several pre-trial rulings, including the granting of partial summary judgment, the EPC contractor agreed to settle days before a jury selection saving the client saving more than $60 million in costs that had been claimed by the contractor.

      Represented owner in ICC arbitration against its EPC contractor over with more than $35 million in claims arising out of the construction of an LPG plant in Trinidad.

      Represented owner in negotiation of contract for the construction of an iron ore reduction facility in Lafayette, Louisiana.

      Represented lender in connection with the development of a pectin processing plant constructed in Ireland for Atlanta-based beverage company.

    • Represented construction manager in contract negotiations and claims arising out of the construction of the Georgia Dome, Centennial Olympic Stadium, Turner Field, and Philips Arena projects in Atlanta.

      Represented construction manager in connection with the construction of additions to football and basketball stadia at the University of Georgia, University of Arkansas, Louisiana State University, University of South Carolina, Clemson University, University of Mississippi, and Georgia Institute of Technology.

  • Healthcare
    • Represented contractor in connection with the negotiation of the contract for the construction of the CDC’s Building 21, which serves as the CDC headquarters and emergency operations building at the agency’s Edward R. Roybal campus in Atlanta. The 12-story facility was designed and constructed with extensive use of innovative materials. The project received Silver LEED certification, incorporates numerous energy-efficient systems, and meets the CDC’s lifecycle requirements of 50-75 years.

      Represented contractor in contract negotiations and claims arising out of the construction of additions to Emory University Hospital and Piedmont Hospital in Atlanta and the Children’s Medical Center on the campus of the Medical College of Georgia in Augusta.

      Represented Grady Memorial Hospital in Atlanta in connection with its four-phase expansion project.

    • Represented the construction manager in contract negotiations for the construction of airline terminal buildings for Delta Airlines at Boston Logan Airport and Tampa International Airport.

      Represented the construction manager in contract negotiations for the construction of air cargo distribution facilities in Miami, New York, and Cincinnati.

      Represented design architect in connection with claims arising out of the design of a replacement international terminal at Atlanta’s Hartsfield-Jackson International Airport.
