Represented a national mortgage servicer in negotiating the first national mortgage settlement with the attorneys general for 49 states and the District of Columbia, various state regulators, and several federal agencies. Bradley worked with the servicer to implement the requirements of the settlement, develop the required testing regime, and represent the servicer during the ongoing monitorship. Bradley continued this representation on behalf of the servicer’s successors after the sale of the servicer and transfer of liability.
Represented three additional national mortgage servicers in negotiating and implementing separate national mortgage settlements with the attorneys general for 49 states and the District of Columbia, applicable federal agencies, and—for one servicer—various state regulators. Bradley worked with two of the servicers to implement the requirements of the individual national mortgage settlements, develop the required testing regime, and represent the servicer during the ongoing monitorship.
Represented a national mortgage servicer and its affiliated companies in an investigation into modification and foreclosure notice practices, eventually settling all claims. Bradley responded to investigatory subpoenas from the Massachusetts attorney general and ultimately negotiated favorable settlement terms, resulting in the entry of an assurance of discontinuance.
Represented a pair of national mortgage servicers in examinations by the Minnesota Department of Commerce regarding alleged financial incentives from a lender-placed insurance vendor in violation of state rebate and UDAAP statutes.
Represented a national mortgage servicer as lead negotiators to resolve administrative actions filed on the same day by regulators for 29 states and the District of Columbia that imposed restrictions on the servicer’s license to operate. In addition, Bradley worked with the servicer to develop the strategy for the initial response to each state’s administrative action and lead the execution of the strategy for several states.
Represented a national bank in an investigation by the New York Commission on Human Rights into discriminatory mortgage origination practices.
